<h3>Dans <a href="https://www.college-de-france.fr/site/francois-heran/index.htm">votre travail</a>, vous expliquez qu’il est difficile d’unifier les politiques migratoires de pays ayant des histoires démographiques différentes. Pourquoi est-il difficile d’avoir une politique migratoire unifiée européenne ?</h3>
|

<p>Il y a d’abord le poids de la géographie. L’Europe est composée de pays insulaires, éloignés des zones de conflits comme la Grande-Bretagne, mais aussi de petite taille, qui sont très exposés comme Chypre ou Malte. D’autre part, il y a <a href="https://legrandcontinent.eu/fr/2019/07/01/europeens-vous-valez-davantage-que-vos-mythes/">le poids de l’histoire</a>. Les anciens pays communistes qui se sont émancipés de la tutelle de l’URSS refusent ce qu’ils perçoivent comme une nouvelle tutelle de Bruxelles. À côté, des pays comme la Suède ont une grande tradition d’accueil des demandeurs d’asile, notamment venant du Moyen-Orient et de la Corne de l’Afrique. Certains pays ont longtemps été des pays d’émigration, et sont devenus des pays d’immigration. Ils ne sont pas équipés juridiquement pour accueillir des demandes d’asile. Enfin il y a des pays d’immigration comme la France ou l’Allemagne qui ont fait appel à des immigrés de l’Europe du Sud, du Maghreb, de la Turquie, pour assurer leur croissance dans les années d’après-guerre.</p>

<p>Par ailleurs, il faut être attentif aux différences de rythmes migratoires. Le profil de migration en Allemagne est un profil de montagnes russes qui épouse les crises. Cela est lié à sa force caritative importante, liée pour partie à la religion. La France a une migration plus stable, que j’appelle ordinaire. Son approche me semble plus imprégnée de légalisme. On considère que c’est à l’État de s’en occuper.</p>

||
<h3>Vous évoquez les différences entre les politiques migratoires de la France et de l’Allemagne. Pourquoi la France est-elle moins engagée dans le droit d’asile ?</h3>
|
||
|
||
|
||
|
||
<p>Depuis les années 1990, une loi est promulguée environ tous les deux ans pour restreindre le droit d’asile. On accueille certes beaucoup de migrants, mais c’est un flux massif continu.</p>
|
||
|
||
|
||
|
||
<p>Par ailleurs, l’opinion publique perçoit qu’il y a un changement dans la composition de la migration. La part du Maghreb et de l’Afrique subsaharienne a dépassé les 40 %<span id='easy-footnote-1-61931' class='easy-footnote-margin-adjust'></span><span class='easy-footnote'><a href='#easy-footnote-bottom-1-61931' title='En stock&#160;: ensemble de la population recensée à un moment donné'><sup>1</sup></a></span> alors qu’elle s’établissait autour des 20 % dans les années 1970. Des quartiers entiers ont changé de composition.</p>

<p>L’opinion publique oublie néanmoins que les migrants des générations précédentes étaient aussi mal accueillis. Qu’on se remémore seulement <a href="https://legrandcontinent.eu/fr/2018/07/02/lhistorien-face-aux-migrations/">le tristement célèbre massacre d’Aigues-Mortes.</a> Moins connue est l’hostilité constante vis-à-vis des Belges pendant le Second Empire. Mais je perçois une rupture entre le passé et aujourd’hui : autrefois on était d’accord sur le fait que l’intégration prenait du temps ; désormais on met la barre toujours plus haut toujours plus tôt : il faut avoir déjà les ressources, savoir déjà le français.</p>

<h3>La politique de l’immigration choisie est souvent présentée comme une solution par les partis anti-immigration européens. Est-ce une solution pertinente selon vous ?</h3>
|
||
|
||
|
||
|
||
<p>Non, c’est un échec total. Seul le Canada, l’Australie, la Nouvelle-Zélande ont une politique d’immigration choisie dans le monde. Cela est lié au fait que l’immigration canadienne, pour ne citer qu’elle, est à plus de 60 % une immigration de travail. Depuis qu’elle a été interrompue en France, en 1974, elle ne représente que 12 à 13 % des titres de séjour. Nous sommes en revanche les champions du <a href="https://legrandcontinent.eu/fr/2018/04/23/la-cjue-precise-les-regles-procedurales-du-regroupement-familial/">regroupement familial</a>.</p>

||
|
||
<h3>Peut-on dès lors avancer que l’immigration française est principalement une immigration « de droit », ainsi que vous l’avez expliqué dans une de vos conférences ?</h3>
|
||
|
||
|
||
|
||
<p>Certes on accueille en France la plupart des migrants au nom du droit. Il y a, premièrement, la composante du <a href="https://legrandcontinent.eu/fr/2018/04/23/la-cjue-precise-les-regles-procedurales-du-regroupement-familial/">regroupement familial</a>, qui désigne le droit d’un étranger à faire venir son conjoint et sa famille et d’un français à faire venir son conjoint. Deuxièmement, le regroupement, les migrations matrimoniales auprès d’un français. Troisièmement, la régularisation par l’existence de liens familiaux.</p>

<p>Mais c’est plus compliqué. Dans <em>Parenté sans papiers</em>, Frédérique Fogel<em> </em>montre de façon précise qu’il y a une zone grise complexe entre le non-droit et le droit ; et non deux espèces d’humanités différentes. Être immigré, c’est être pris dans une série de procédures. Les migrants doivent patienter avant d’obtenir des papiers. Pendant cette période, paradoxalement, les sans-papiers accumulent les papiers pour convaincre les guichets qu’ils méritent de recevoir le titre définitif. Ils peuvent payer des impôts, recevoir une aide sociale. Il n’y a donc pas de dichotomie fondamentale.</p>

<h3>Pour un candidat désireux de limiter les migrations par regroupement familial à l’échelle nationale, la seule solution est-elle, dès lors, de sortir de la Convention européenne des droits de l’homme en raison du contenu de l’article 8 relatif au respect de la vie privée et familiale, ainsi que l’avait suggéré François Fillon en 2017 ?</h3>

||
|
||
|
||
|
||
<p>Pour François Fillon il y avait trop de juridisme, il fallait se libérer du gouvernement des juges. Son argumentaire passait par la dénonciation d’une instance extérieure, d’une intrusion des institutions européennes contre le souverainisme. Il faudrait donc prendre modèle sur le Danemark, lequel a interdit regroupement familial à partir de seize ans. Il ne peut donc plus prétendre qu’il souscrit à la Convention internationale des droits de l’enfant. Mais ce que peut se permettre le Danemark, la France le peut-elle ?</p>

||
|
||
|
||
|
||
<h3>Qu’en est-il de l’immigration clandestine en Europe ?</h3>
|
||
|
||
|
||
|
||
<p>Il n’existe pas de données sur l’immigration clandestine, seulement des indicateurs, des estimations. <a rel="noreferrer noopener" href="https://www.oecd.org/migration/mig/2717683.pdf" target="_blank">Un rapport de Georges Tapinos</a> à la fin des années 2000 énumère les différentes méthodes possibles. Mais l’extrapolation est quasiment impossible. En France on utilise l’aide médicale d’État.</p>
|
||
|
||
|
||
|
||
<p>En réalité, il n’y a pas de coupure tranchée entre légaux et illégaux. Ce ne sont pas des catégories étanches. La situation des migrants correspond le plus souvent à un statut intermédiaire : les sans-papiers ont quand même une sorte de statut : ce ne sont pas de gens qui n’existent nulle part, qui n’auraient aucun papier, qui ne seraient enregistrés nulle part. <p>D’autre part comment parler d’immigration illégale à l’échelle européenne ? Les critères sont propres à chaque pays de l’Union. Au total, ce qui me frappe, c’est le droit du temps. <p>L’hypothèse de Stephen Smith consiste à dire que la migration subsaharienne va doubler, voire quintupler d’ici 2050, en raison de la haute fécondité. 25 % de l’Europe serait Africaine. Une « ruée » écrit-il : c’est un terme choquant et l’éditeur commet une faute en acceptant de publier un titre pareil. « <em>The scramble</em> », qui désigne une bousculade désordonnée, fait allusion au « <em>scramble for Africa</em> » des colonialistes.</p>

<p>Le modèle de Smith repose sur l’idée que la population subsaharienne en Europe va plus que doubler en raison de la croissance économique de l’Afrique, qui va accélérer. Une hypothèse qui n’est pas irréaliste selon Michèle Tribalat : la population subsaharienne a été multipliée par cinq depuis le recensement de 1982. Mais on peut apporter la preuve par le contraire : la population anglaise aussi a été multipliée par cinq depuis 1982, or personne ne soutiendrait qu’elle va quintupler ni même doubler dans les années à venir ! On ne peut pas soutenir l’hypothèse que le rythme d’émergence d’une nouvelle communauté se maintienne au fil des décennies.</p>

Il s’avère que 22 % de la population de cette région de l’Europe vit à l’étranger, contre seulement 2 % de la population subsaharienne. Voilà de quoi l’on devrait s’occuper. Les Balkans ont des taux de fécondité très bas, ce qui dément donc radicalement l’idée commune selon laquelle ce sont les pays très féconds qui vont se déverser dans les pays moins féconds.</p>

<p>En réalité, l’idée de Smith est que la croissance économique de l’Afrique nous menace. On ne voit pas sur quoi repose cette hypothèse ; il ne s’appuie d’ailleurs sur aucune analyse de base de données et il travaille par analogie. Comment un travail d’un tel amateurisme a-t-il pu avoir un impact aussi fort ? C’est qu’il réveille des peurs fortes. En France, la culture des statistiques est réduite.</p>

<p>Cette hypothèse semble peu crédible. Les migrants sont aussi des producteurs, des consommateurs, des contribuables, des cotisants. Ils cotisent moins parce qu’ils sont plus pauvres que la moyenne, mais ils se concentrent davantage dans les âges actifs, ce qui apporte une compensation. L’idée d’une incompatibilité de la protection sociale et de l’immigration n’a jamais été démontrée. Le thème du « tourisme social », cette idée que les migrants choisissent leur destination en fonction des allocations et aides qui leur sont allouées, est infirmée par le fait que l’un des plus grands flux migratoires dans monde se dirige vers les États-Unis.</p>

C’est une question de justice spatiale. Il y a dans le monde des inégalités spatiales fortes. Des pays bénéficient de rentes de situation, dans les détroits par exemple, alors que d’autres sont enclavés. Or les inégalités géographiques sont considérables au sein de l’Europe.</p>
