<p>Indígenas de Agua Caliente han enviado múltiples solicitudes y hasta viajaron en dos ocasiones a Costa Rica para que la Corte reconozca a sus líderes comunales.</p>
|
||
|
|
<p>Luego de más de un mes en que las legítimas autoridades de la comunidad indígena Lote 9, ubicada en Agua Caliente, El Estor, Guatemala, se presentaran con sus requerimientos ante la Corte Interamericana de Derechos Humanos (CIDH), los jueces no responden.</p>
|
||
|
|
<p>Han enviado correos y cartas desde febrero de este año y no han tenido respuesta. (ver fotografía #2)</p>
|
||
|
|
<p>En una entrevista telefónica con el alcalde comunitario y guía principal de la comunidad, Alfredo Chub, este indicó: “Durante meses hemos mandado varios documentos y solicitudes. Además, fuimos dos veces a Costa Rica y tocamos las puertas de la Corte, pero no nos escucharon, no respondieron a nuestras solicitudes y los jueces no dan la cara, no sabemos qué más hacer para exigir justicia”.</p>
|
||
|
|
<p>Los comunitarios indígenas denuncian ser objeto de discriminación y violación de derechos humanos por parte de la misma CIDH, ya que no se les ha permitido participar como legítimos representantes de la comunidad en el caso que se lleva en contra del Estado de Guatemala.</p>
|
||
|
|
<p>“Rodrigo Tot no nos representa”</p>
|
||
|
|
<p>Este caso empezó hace seis años cuando Rodrigo Tot demandó al Estado de Guatemala por el incumplimiento de la certeza jurídica de las tierras. Sin embargo, estos líderes indígenas de Lote 9 señalan que Tot no los representa y solo quiere aprovecharse de esta demanda por intereses personales.</p>
|
||
|
|
<p>“Él no vive desde el 2018 en la comunidad, ya no participa en ninguna asamblea comunitaria, nos molesta porque está buscando beneficios personales usando el nombre de nuestra comunidad”, indicó</p>
|
||
|
|
<p>Carlos Asig, integrante del Consejo Comunitario de Desarrollo (Cocode), quien también es hijo del fundador de la comunidad Agua Caliente, Lote 9. Él asegura que Rodrigo Tot está demandando al Estado haciéndose pasar por autoridad comunitaria.</p>
|
||
|
|
<p>Los líderes comunitarios representan los intereses de las 64 familias que viven en Agua Caliente Lote 9, quienes en marzo recién pasado visitaron Costa Rica en dos ocasiones con el acompañamiento de la Asociación Sa’Komonil. Los comunitarios solicitan que se desconozca a Rodrigo Tot como representante ante esta Corte, ya que dicha persona no vive en la comunidad y no los representa, aparte de que su objetivo se basa en intereses personales y familiares.</p>
|
||
|
|
<p>“Hemos presentado diferentes comunicaciones ante la CIDH, entidad llamada a resguardar los derechos humanos, entre ellos la honra y dignidad de nuestro nombre. Pese a múltiples requerimientos la Corte se ha negado a atender nuestras solicitudes”, concluyó Chub.</p>
|
||
|
|
<p>Por su parte Romel Reyes, de la Asociación Sa’Komonil, indicó a DIARIO EXTRA que vinieron a solicitar audiencia ante la Corte y presentaron ante la CIDH “una petición para que se respeten los acuerdos a los que han llegado estas 64 familias con el Estado de Guatemala. ¿Cómo es posible que la Corte no nos responda? Están metiendo a nuestra comunidad como demandante del Estado de Guatemala, como si no nos hubiese dado derecho sobre nuestra tierra. Nuestra comunidad sabe que desde el 2020 el Fondo de Tierras nos dio nuestro título de propiedad a las 64 familias”, aseveró.</p>
|
||
|
|
<p>Documentos entregados a la CIDH</p>
|
||
|
|
<p>Los señores líderes de la comunidad Agua Caliente Lote 9, entregaron a la CIDH un documento en el cual se expone cómo “el señor Rodrigo Tot, quien se ha atribuido la representación de la Comunidad Agua Caliente Lote 9, no ostenta dicha calidad, sino actúa en busca de beneficios e intereses personales junto con su núcleo familiar”. Este documento se une a muchos de los que han enviado desde el 7 de febrero, como es el que asegura cuáles son los líderes legales de la comunidad.</p>
|
||
|
|
<p>Estos son sus argumentos expuestos ante la Corte:</p>
|
||
|
|
<p>A lo ya expuesto en oportunidades anteriores hoy queremos evidenciar el conflicto de intereses del Señor Tot y cómo sus acciones son incongruentes a la luz del ordenamiento jurídico:</p>
|
||
|
|
<p>a. En la audiencia celebrada el 9 de febrero del año en curso, de viva voz, el Señor Tot expresó que él y su familia son víctimas de abusos y su integridad estaba en riesgo, derivado de los opositores a sus acciones en favor y protección de la comunidad, así como su oposición a la actividad minera en la región por los daños que consideraba podrían causar. Incluso llegó a inferir que la pérdida de un hijo en un hecho de violencia fue producto de represalias en su contra.</p>
|
||
|
|
<p>b. No obstante lo expresado, resulta que el Señor Tot es beneficiario directo de las empresas mineras, en virtud de los servicios que de forma personal y a través de su familia presta, ya que el negocio familiar es el transporte de mineral y uno de sus principales clientes es la empresa Mayaniquel, la cual le representa ingresos importantes, para lo cual nos permitimos presentar un estimado: La familia Tot tiene aproximadamente 15 camiones y 5 góndolas, los que generan los siguientes ingresos:</p>
|
||
|
|
<p>- Un camión hace 5 viajes durante el día, siendo que en cada viaje se trasladan 19 toneladas. Por cada tonelada se paga $2.80 dólares, es decir cada viaje representa $53.20, para un total</p>
|
||
|
|
<p>diario de $266.00 por camión. Si se estima que son 15 camiones, diariamente genera $3,990.00, para totalizar $119,700.00 mensuales.</p>
|
||
|
|
<p>- Una góndola hace 1 viaje durante el día, la cual traslada 25 toneladas. Por cada tonelada se paga $10.00, es decir cada viaje representa $250.00. Si se estima que son 5 góndolas, diariamente genera $1,250.00, para totalizar $37,500.00 mensuales.</p>
|
||
|
|
<p>c. Conociendo estos datos, es evidente el conflicto de intereses antes mencionado, ya que teniendo un ingreso aproximado de US$157,200 mensuales resulta incongruente lo expresado de viva voz ante la honorable Corte en la audiencia a la que fue citado el pasado 9 de febrero ilegítimamente presentándose como presunta víctima.</p>
|
||
|
|
<p>d. No nos oponemos ni condenamos su actividad comercial pues finalmente cualquier actividad comercial representa desarrollo y es muestra de las fuentes de empleo y oportunidades que generan las empresas mineras, sino más bien lo evidenciamos por la falsa representación que ha hecho Rodrigo Tot de la realidad. Se hace evidente la falsedad con la que Rodrigo Tot actúa, mientras la comunidad vive en una total pobreza, Rodrigo Tot y su familia recibe grandes ingresos mensuales, producto del comercio del transporte con la entidad que tiene actividad mercantil, denominada Mayaniquel. El problema no es su actividad comercial, el problema es pretender engañar a la honorable Corte con argumentos e historias falsas, sobre todo con una representación falsa. Rodrigo Tot en todo momento ha actuado en pro de intereses personales, con el objetivo de ganar poder, crear conflicto social y aprovecharse de la comunidad. Nosotros, los comunitarios que sí representamos a la comunidad Agua Caliente Lote 9, de conformidad con las leyes de Guatemala, lo único que pretendemos es vivir en paz, mantener la buena armonía de nuestra comunidad y cerrar este caso que no nos beneficia ni es de interés. El presente caso expone a nuestra comunidad públicamente y nos somete a una vergüenza pública que no podemos permitir, toda vez que el Estado de Guatemala ya cumplió con entregarnos nuestro título.</p>
|
||
|
|
<p>e. <p>Respeto a los derechos humanos</p>
|
||
|
|
<p>Las autoridades indígenas solicitan a la CIDH que, además de cerrar el caso, no se violenten los derechos humanos de la comunidad indígena, como son la honra, la dignidad y la reputación. Además solicitan que se reconozca la personalidad jurídica y los derechos civiles de la comunidad, y el derecho a la justicia.</p>

<p>Los representantes indígenas solicitaron audiencia personalmente a la CIDH para ser atendidos por los jueces. Sin embargo, aún no se les ha confirmado su audiencia, a pesar de las múltiples cartas y correos electrónicos enviados durante varios meses, y de haber venido desde Guatemala personalmente por segunda vez.</p>
